FennIQ.ai Terms & Conditions

These Terms and Conditions (“Terms”) govern the purchase, delivery, and use of FennIQ.ai products and services, including construction lead intelligence services and homeowner lead list data (“Services”). By purchasing, receiving, or using any Service, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Service Description

FennIQ.ai provides data acquisition and delivery services that aggregate, evaluate, enrich, and deliver lead datasets based on customer-defined criteria. These services include construction or project intelligence and homeowner renewal lead lists.

Some services are provided on a recurring schedule and others are delivered as single purchase data files. Delivery consists of data only and FennIQ.ai does not provide outreach execution or guaranteed business outcomes. FennIQ.ai does not perform Do Not Call or TCPA compliance scrubbing. Users are responsible for all consent and compliance checks before contacting any record.

In the future, FennIQ.ai may offer:

  • Multiple service tiers, which may limit the number or type of leads delivered;

  • Additional tools and modules, including but not limited to: spec document retrieval, contact enrichment, custom alerts, or competitive analysis.

 

Your use of any future tool will be governed by these Terms unless otherwise stated.

FennIQ.ai is operated under a registered DBA owned by Salladale Group, LLC, a Texas limited liability company. All terms herein apply equally to the DBA and its parent entity.

2. Linked Policies

By subscribing to FennIQ.ai or using the FennIQ AI Lead Finder, you also agree to the terms outlined in our:​

 

These documents are incorporated by reference into these Terms and Conditions and should be reviewed alongside this agreement. In the event of a conflict between this document and any linked policy, the referenced policy shall govern.

3. Subscription, Billing, & Cancellation

  • All services are provided on a subscription basis, billed monthly in advance.

  • Subscriptions auto-renew unless cancelled before the next billing cycle.

  • You may cancel at any time, but no refunds or partial credits will be issued.

  • Payment processing is handled by a third party; you authorize FennIQ.ai to charge your designated payment method.

  • Some services, such as delivered lead list products, are sold as one time purchases rather than recurring subscriptions. These orders do not renew unless specifically stated.

 

We reserve the right to change pricing or introduce new subscription tiers. You will be notified in advance of any changes affecting your account.

4. Usage Rights & Limitations

These rights apply to subscription services and to delivered datasets purchased through the site.:

  • Your plan may limit the number of leads, queries, or records processed per billing period.

  • Usage beyond your plan may be restricted, throttled, or incur additional charges.

You may not:

  • Share, resell, or redistribute any data or insights obtained from the Service;

  • Circumvent usage limits or access methods;

  • Use the Service to conduct illegal or misleading activities;

  • Interfere with system security, APIs, or automation;

  • Reverse engineer, decompile, or attempt to extract source logic from AI or backend systems.

Accounts found in violation may be suspended or terminated without refund.

5. AI Limitations & Data Accuracy

The Service and delivered data products leverage public and proprietary sources combined with automated reasoning. While we strive for relevance, accuracy, and recency, inherent limitations remain. Data elements may originate from sources outside our control and may change or become outdated without notice.

 

We do not guarantee that:

 

  • Leads are current, complete, reachable, or error free.

  • Project or property details are accurate or actionable.

  • Contact or location information is valid, current, or responsive.

  • Delivered datasets will produce business outcomes, closed deals, or revenue.

 

Users are responsible for independently verifying any data obtained before acting upon it. FennIQ.ai does not perform Do Not Call or TCPA compliance scrubbing. Users must conduct their own compliance screening and assume responsibility for any outreach activity.

6. Account & Security

If access credentials or an account are provided, you are responsible for maintaining the confidentiality of your login information and for any actions taken using your credentials. Some products are delivered without requiring account access, but when an account is used, you must protect it.

You agree that:

  • Your registration, billing, or delivery information will be accurate and kept current.

  • You will not share account credentials or access with unauthorized individuals or entities.

  • You will notify FennIQ.ai immediately of any suspected breach or unauthorized use.

FennIQ.ai may suspend or restrict access in order to protect account integrity or prevent misuse. You are responsible for securing access credentials, delivery files, and any data you receive under this Service.

7. Ownership & Intellectial Property

All data, enrichment logic, list outputs, and supporting materials are proprietary to FennIQ.ai. Purchase or receipt of data does not transfer ownership rights.

 

You agree that you will not:

 

  • Claim ownership of delivered datasets or outputs.

  • Copy, reproduce, resell, republish, or redistribute the data.

  • Use the data to create or support a competing data or lead delivery product.

 

FennIQ.ai retains all rights, title, and interest in the Service and any data provided, including methods used to source, enrich, or assemble the information.

8. Termination & Enforcement

FennIQ.ai may limit, suspend, or terminate access to services or delivery of data if misuse is detected or these Terms are violated.

 

We may restrict or terminate access if:

 

  • You abuse or interfere with service delivery.

  • Unauthorized access or account sharing occurs.

  • Delivered datasets are resold, redistributed, or used outside permitted internal business purposes.

  • Payment is reversed, disputed, or fraudulent behavior is identified.

 

Termination or restriction under this section does not entitle you to a refund. FennIQ.ai may apply technical, contractual, or legal remedies to protect data integrity, proprietary assets, or enforce these Terms.

9. Modifications to the Service

FennIQ.ai may update, enhance, adjust, or discontinue aspects of the Services in order to improve performance, meet operational requirements, or reflect changes in data sources.

 

Modifications may include:

 

  • Updates to data sourcing or enrichment methods.

  • Adjustments to filtering or delivery criteria.

  • Changes to availability or structure of list based or recurring services.

  • Replacement or removal of features, datasets, or outputs.

 

Continued use or ordering of Services after changes have been made constitutes acceptance of those modifications.

10.  Limitation of Liability

To the fullest extent permitted by law:

  • FennIQ.ai will not be liable for any indirect, incidental, special, or consequential damages, including loss of revenue or opportunity, or any claims arising from the use of construction project intelligence data, homeowner lead lists, or any other delivered dataset.

  • FennIQ.ai does not guarantee the accuracy, completeness, responsiveness, or performance of any record or dataset, and you are solely responsible for any regulatory compliance requirements, including Do Not Call and TCPA obligations when contacting leads or acting on the data.

  • Our total liability for any claim shall not exceed the amount paid by you in the past three (3) months.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Texas. You agree to submit to the exclusive jurisdiction of the state or federal courts located in Tarrant County, Texas, for any disputes.

12. Refund Policy

All subscription or per-delivery purchases are governed by our Refund Policy. Please review it carefully. FennIQ.ai subscriptions are non-refundable except in the rare circumstances outlined therein.

13. Data Usage & Privacy Policy

FennIQ.ai only collects and uses data as outlined in our Privacy Policy. We do not sell or rent your personal information. All data provided to users is ethically and legally sourced from public, open-source platforms and third-party providers where permitted.

 

Users are solely responsible for how they use any construction project intelligence, homeowner lead list, or other data obtained under this agreement, including compliance with applicable privacy, Do Not Call, and outreach regulations.

14. Shipping & Delivery Policy

All products are delivered electronically to the email address or platform(s) associated with your account. Delivery may occur via email, RSS feed, or other integrations or methods. A product is considered delivered once our system triggers the delivery process, not when the user receives or accesses it. Refer to our Shipping & Delivery Policy for full delivery terms.

For purchased lead lists, delivery occurs when records are made available for viewing or download.

14. Future Products & Scope Expansion

These Terms also apply to any future tools, features, datasets, or products released under the FennIQ.ai brand unless explicitly stated otherwise. Your use of any such tools indicates your agreement to any updated or supplemental terms issued with them.

15. Dispute Resolution

Before initiating any formal legal action, both parties agree to first attempt to resolve any dispute, claim, or controversy arising from these Terms or the Service through informal negotiation. If the dispute is not resolved within thirty (30) days, either party may pursue binding arbitration in Tarrant County, Texas, under the rules of the American Arbitration Association.

Data quality or performance claims must be reviewed through internal resolution procedures before any formal dispute may be initiated.
 
Nothing in this section limits FennIQ.ai’s right to seek equitable relief, including injunctions, in cases of misuse or unauthorized access to proprietary data or systems.
